The guidelines include provisions that limit the expansion of legacy facilities in certain foreign countries. Semiconductor companies operating in these countries will be restricted to a maximum 5% increase for advanced chips and a 10% increase for legacy chips. Furthermore, under the statute, recipients of CHIPS funds are prohibited from using the funds for constructing, modifying, or improving semiconductor facilities outside of the United States. The guidelines also restrict recipients from engaging in joint research or technology licensing efforts with foreign entities of concern.
