US Commerce Department Issues Guidelines for CHIPS Funding

The US Commerce Department has released the finalised national security guidelines that semiconductor manufacturers must adhere to in order to receive funding under the CHIPS and Science Act. This act, passed last year, aims to boost domestic semiconductor research and manufacturing to enhance competitiveness against China and address the global semiconductor shortage.

Incentives and Restrictions

The guidelines include provisions that limit the expansion of legacy facilities in certain foreign countries. Semiconductor companies operating in these countries will be restricted to a maximum 5% increase for advanced chips and a 10% increase for legacy chips. Furthermore, under the statute, recipients of CHIPS funds are prohibited from using the funds for constructing, modifying, or improving semiconductor facilities outside of the United States. The guidelines also restrict recipients from engaging in joint research or technology licensing efforts with foreign entities of concern.

Cracking Down on Violations

The Commerce Department firmly stated that it has the authority to "claw back" the entire federal financial assistance award if the guidelines are violated.
